ARTICLE 1 - GENERAL

These general conditions of sale govern the relationship between, on the one hand, the company ecoLoco, RCS 503 898 371 00011, whose head office is located at 1 plan des aramons 34970 Lattes France hereinafter referred to as "ecoLoco" or under his domain name www.ecoloco.fr, and on the other hand, the person making a purchase remotely (via the Internet or by mail), hereinafter referred to as the "Customer". The Parties agree that orders placed with ecoLoco via the various means made available to the Customer are governed exclusively by these general conditions of sale, to the exclusion of any other condition that would be available on the website www.ecoloco. fr.

ARTICLE 2 - PRODUCTS

The photographs illustrating the products are as faithful as possible but can not sometimes ensure a perfect similarity with the product offered, especially as regards the colors. The photographs, texts, graphics, as well as all the information and characteristics illustrating and / or accompanying the products, do not enter the contractual field. Consequently, in case of error or omission of any of these elements or in the event of modification of these elements, the responsibility of ecoLoco could not be committed. The buyer remains the sole judge of the compatibility of the products ordered with the presentation materials already in his possession. The products presented are delivered within the limits of available stocks. When there is an unavailability on a product ordered, the customer is immediately informed by email. In case of unavailability or out of stock, the item is removed from the catalog as soon as possible and the customer can ask to be reimbursed or to have a credit on a later order.

ARTICLE 3 - ORDER TERMS
The Customer declares to have read and accepted the present general conditions of sale before the validation of order, ie by checking the box in the page "summary" of the order on the site.
The data recorded by ecoLoco constitute the proof of all transactions between ecoLoco and its Customers. EcoLoco will systematically confirm the Customer's order and send it by email. Any order confirmed by the Customer is the conclusion of the sales contract. The Customer is considered to have accepted knowingly and without reserve the prices, volumes and quantities offered for sale and the clauses contained in these general conditions of sale. A confirmation email summarizing the order, modes and delivery times (products, price, quantity ...) will be sent to the Customer by ecoLoco.
The information given by the Customer when placing an order is binding on the latter: in the event of an error in the addressee's address, ecoLoco can not be held responsible for the impossibility in which ecoLoco could deliver the product. .
The order will be taken into account by ecoLoco only if the Customer has clearly identified himself by providing the information required in the order form (name, address, telephone, email, etc.).
When registering the Customer's personal data in the "my account" section, the Customer must ensure the accuracy and completeness of the mandatory data that he provides. Any subsequent changes must be mentioned as soon as possible.
The Customer declares to have the legal capacity or to hold parental authorization if he is a minor, allowing him to place an order on the site.
ARTICLE 4: VALIDATION
Clicking the "Submit" button at the end of the order process implies full and unreserved acceptance of it and these General Terms and Conditions of Sale.

ARTICLE 5: DELIVERY
The products will be sent to the delivery address that the buyer has indicated during the ordering process. Participation in processing and shipping costs is inclusive of VAT.
When shipping a complete order, ecoLoco provides an original invoice including delivery charges and VAT, which can be downloaded directly from the customer's account.
Deliveries to Metropolitan France including Corsica, Monaco, Andorra are made by La Poste Colissimo, or Letter Follow, or Mondial Relay. Deliveries to DOM (Overseas Departments: Guadeloupe, Guyana, Martinique, Mayotte, Reunion), TOM (Overseas Territories - New Caledonia, French Polynesia, Wallis and Futuna, French Southern and Antarctic Lands) , and Territorial Communities (Saint-Pierre and Miquelon) are made by La Poste Colissimo Access. For deliveries outside metropolitan France the customer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and any other taxes due under the laws of the country of receipt of the command. All orders placed with ecoLoco are intended for the personal use of the customers, the customers or the recipients of the products are prohibited any partial or total resale of the products. ecoLoco disclaims any legal liability if the payment of taxes was not made by the customer.
Deliveries in EU and non-EU countries are made by La Poste Colissimo International Access (or Mondial Relay for some countries). Packages are delivered without signature to the address that the customer has mentioned on his order, directly in his mailbox, provided to have a mailbox to the standards imposed by the Post. In case of impossibility of access, a notice is placed in the mailbox: it is then possible to withdraw the parcel at the post office mentioned on the notice of passage within 15 days after the deposit of this opinion. Beyond this period, the parcel is returned to the sender. It can then be reshipped after payment by the customer of new shipping costs. In case of refusal of redelivery by the customer, it will be refunded the amount of his order less shipping costs. In the case where the delivery address is different from the billing address, it is appropriate for the customer to indicate these two separate addresses in the section provided for this purpose, when ordering. It is also the responsibility of the customer to provide all useful information for delivery when ordering to allow the carrier to proceed with delivery. In case of erroneous or incomplete information that has made it impossible for the carrier to proceed with the delivery, a second delivery will be made after the return by the carrier of the goods to the company ecoLoco, this by means of the advance payment of the amount of new shipping cost from the customer.  For reasons of availability, an order can be delivered in several times to the customer. The customer pays only once the shipping costs. If the customer wants two different delivery locations, he then places 2 orders, and pays the delivery fee for two separate orders. Unless otherwise stipulated, the products are delivered within the times indicated below, when the order is placed. The timeout may result in the cancellation of the order by the Customer (except in case of force majeure), if he requests it and his order is not being prepared logistically. The delivery time is 2 weeks maximum (working days) except in cases of force majeure and unless otherwise indicated on site (holidays, inventory ...) ecoLoco undertakes to minimize the delivery time to 72 hours as far as possible ( working days), each order placed before 12h from Monday to Friday being prepared and dispatched the same day. In the event of non-respect of the delivery deadline indicated to the customer during the confirmation of his order, the Customer will be able to obtain resolution of the sale. As of the exercise of the right to terminate, ecoLoco will make a refund according to the terms defined in agreement with the customer within 30 days following the date on which the right was exercised. The customer has a period of 48 hours to make any reservations with the carrier in case of missing or damaged. If the delivered products do not conform in kind or quantity to the specifications indicated in the delivery note, the Customer must, under pain of forfeiture, make its claims within seven days after delivery. When a parcel leaves the ecoLoco warehouses, it is sent by La Poste, mail with tracking number. EcoLoco sends an email informing the customer of the dispatch of his order with the tracking number. However, if 5 working days after the dispatch of the parcel, the Customer has no news of his order, he must approach the Post Office and ecoLoco who will launch a complaint with the Post Office to locate the parcel. If neither the post office nor the tracking of parcels say to have trace of this parcel, the Customer must then appear with ecoLoco. For any shipment followed without a signature indicated as delivered by the site of the Post Office, but of which the Customer would not have trace, ecoLoco will not be able to intervene and the Customer will have to approach his nearest post office. The ecoLoco Customer Service will then open an inquiry with the Swiss Post services. The Customer will then receive an email indicating that an investigation is open. The final response time of the Post varies from one to three weeks, from the sending of the email sent to the Customer. Pending the response of the Post Office, ecoLoco is not required to refund or replace the package pending delivery, without firm and definitive response of the services of the Post. After investigation and reply from the Post Office, indicating that the parcel is lost, ecoLoco returns the goods or refunds it according to the customer's choice. If however, the Post office claims to have delivered the parcel to the customer, ecoLoco neither refund nor return the goods.
ARTICLE 6: PAYMENT
Payment can be made by bank card, check or paypal.
The buyer expressly declares to have all the necessary authorizations to use the method of payment he has chosen at the time of validation of his order. He also undertakes to ensure his solvency before any order. EcoLoco saves itself the possibility of suspending or canceling any order or delivery in case of refusal to issue a payment authorization from the financial organizations questioned, according to the method of payment chosen by the buyer. The buyer is also warned that the company ecoLoco can proceed to the analysis and / or verification of orders placed to guard against possible fraud, and in this context reserves the possibility to ask the customer any evidence she would find it useful. At the end of this procedure, it reserves the right to suspend or cancel any order or delivery, even in the event of authorization of payment issued by the financial organizations concerned, in cases where this analysis and / or these checks would give to believe that the said order has been fraudulent of the rights of a third party. Furthermore, it can not bear any liability in the event of malfeasance or fraudulent use of any means of payment that has not been detected by this analysis and / or verification procedure. Payment is made by credit card bearing the initials CB, Visa or Mastercard. Online, the secure payment allows the customer to settle via the server of the banking partner of ecoLoco (Crédit Mutuel) in a secure environment. The bank card number of the customer is therefore directed to the bank's servers, the payment is made directly to the bank in a secure environment without going through the shop's server. The numbers are known only to the banking partner (Crédit Mutuel ). We do not save any data in our database. The order validated by the customer will be considered effective only when the payment centers concerned will have given their agreement. In case of refusal of said centers, the order will be automatically canceled and the customer notified by email. In addition, ecoLoco reserves the right to refuse any order from a customer with whom there is a dispute. For payments by check, the order validated by the Customer will be considered effective only when the check has been credited to the ecoLoco account. In case of bank refusal, the order will be automatically canceled and the Customer notified by email.
ARTICLE 7: COMPLAINT
This contract is subject to French law. ecoLoco can not be held liable for damages of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the products marketed. The same is true for any modifications of the products resulting from the manufacturers. The responsibility of ecoLoco will, in any case, be limited to the amount of the order and can not be blamed for simple errors or omissions that may have persisted despite all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any action in court, to seek an amicable solution including with the help of: a professional association of the branch, an association of consumers or any other counsel of his choice. It is recalled that the search for the amicable solution does not interrupt the "short delay" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors its financial commitments to the seller. In case of dispute, the customer will first contact the company to obtain an amicable solution. Otherwise, the Commercial Court of Montpellier is the only competent, regardless of the place of delivery and method of payment accepted.
ARTICLE 8: RETRACTATION
The customer can, after having validated his order, retract. All he has to do is call ecoLoco or email him ecolocobio@gmail.com to let him know. If the order has not been shipped yet, ecoLoco will confirm by email the cancellation of the order. No charge will be charged to the customer and the amount of his order will be returned within 48 hours following its withdrawal directly to his bank account, his paypal account or bank check based on its original payment method.
The customer has a withdrawal period of fourteen working days from the delivery of his order allowing him to return at his expense his purchase to ecoLoco for exchange or refund, pursuant to the provisions of articles L 221-18 of the Code de the consumption. This exchange or refund will be made without penalty. The customer can indicate beforehand his intention to return the parcel as part of the exercise of his right of withdrawal to the e-mail address ecolocobio@gmail.com. Delivered products must be returned in perfect condition for resale, intact, in their original packaging, neither worn, nor washed, at the expense of the customer and under his responsibility, with responsibility for him to carry out the insurance of the transport, to the following address: ecoLoco, 6 dead end Jules Guesde 34 080 Montpellier. Subject to compliance with the above provisions, ecoLoco will refund within 14 days of receipt of the products.
If the customer refuses to pick up his parcel post office or global withdrawal point relay, no refund will be made. The expenses of return of the parcel (by post office or global relay) made by the customer remain with his load. A purchase order is possible (after deducting the return paid by ecoLoco) or return the package to the customer.
Insofar as the package remained 14 days in post office or relay point, it is therefore appropriate that no refund or exchange can be made.
No exchange or refund can be made on the voucher.



ARTICLE 9: PRICE
On the site www.ecoloco.fr, prices are expressed in euros and all taxes included. The prices indicated on the product sheets do not include the participation in the shipping costs. The participation in the transport costs is 5.50 euros (postage paid) and 3.50 € (by Mondial Relay) per order, and offered from 60 euros all taxes included. The price indicated during the order confirmation is the final price, expressed all taxes included and including in particular the VAT for France and the countries of the European Union. This price includes the price of the products, the costs of handling, packaging and preservation of the products, as well as the participation in the transport costs. It is payable in cash on the day of the actual order.
Customs duties or other local taxes or import duties or state taxes may be payable. They will be the responsibility of the customer and are his sole responsibility both in terms of declarations and payments to the authorities and / or competent bodies of the country of destination.
ARTICLE 10: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS
The transfer of ownership of the products for the benefit of the purchaser, will be realized after full payment of the price by the latter, regardless of the date of delivery of said products. On the other hand, the transfer of the risks of loss and deterioration of the products will be realized from the delivery and reception of the said products by the Purchaser.

ARTICLE 11: RIGHT OF ACCESS AND RECTIFICATION
The information of the personal information collected for the purposes of the distance selling is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and guarantee contracts. The lack of information leads to the non-validation of the order. ARTICLE 12: APPLICABLE LAW
All the clauses appearing in these general conditions of sale, as well as all the operations of purchase and sale which are referred to it, will be subjected to the French law, the Courts will be those of the spring of Montpellier, Courts of the registered office of ecoLoco where is formed the contract between the parties.

ARTICLE 13: ACCEPTANCE OF THE PURCHASER
The present general conditions of sale as well as the tariffs are expressly approved and accepted by the Buyer, who declares and recognizes to have a perfect knowledge of it, and renounces, therefore, to take advantage of any contradictory document and, in particular, his own general conditions of purchase, the act of purchase resulting in acceptance of these general conditions of sale.
